How can you bring your fiancé to the U.S.?

Bringing your fiancé to the United States involves a detailed process. Understanding each step can make this journey smoother for you and your future spouse. Here is a guide to help you through the fiancé visa process.

Step 1: Filing the petition

Start by filing Form I-129F, Petition for Alien Fiancé, with the United States Citizenship and Immigration Services (USCIS). This form establishes your relationship. Ensure you meet the eligibility criteria. You must be a U.S. citizen, both free to marry, and have met in person at least once in the last two years. USCIS reviews your petition. They may request additional evidence. Once approved, USCIS forwards the petition to the National Visa Center (NVC).

Step 2: Visa application process

The NVC sends the approved petition to the U.S. Embassy or Consulate where your fiancé will apply for the K-1 visa. Your fiancé schedules an interview and prepares necessary documents. A consular officer will assess the application during the interview. If approved, your fiancé receives a visa, valid for six months for a single entry. This visa does not guarantee entry, but it allows travel to the U.S. for inspection at a port of entry.

Step 3: Arrival and marriage

Upon arrival in the United States, your fiancé presents the K-1 visa at a port of entry. A Customs and Border Protection (CBP) officer makes the final decision on entry. Once admitted, you must marry within 90 days. Marriage within this period is crucial for adjusting status to permanent residency.

Step 4: Adjusting status

After marriage, your spouse applies for a Green Card using Form I-485, Application to Register Permanent Residence or Adjust Status. This step involves a review of documents and possibly an interview. If married for less than two years at approval, your spouse becomes a conditional permanent resident. You will later file Form I-751 to remove conditions on residency.
